Bankruptcy Fraud Litigation

There are several ways in which litigation might be a necessary step in getting your debts discharged.   • Adversary Proceeding: When a dischargability complaint has been raised against you, questions have been raised as to whether or not you are truly in need of bankruptcy. If you have made major acquisitions right before filing for bankruptcy, you may have violated creditors' rights and could be found liable for the amounts claimed.
  • Contested Matter: When you file for Chapter 13 bankruptcy, there may be questions as to the fairness of your plan. In the case of a contested matter, you will appear in an informal hearing in front of a judge where the court will undergo an evaluation of your entire estate, including your property, assets, and family law matters such as alimony and support.
  • Bankruptcy Crimes: If you have been accused of fraud, false oath, concealing assets, or any other bankruptcy crimes, we can help you defend your case, even if you were previously represented by another attorney.
